Right to Repair Legislation can force producers to enable product repairs in various ways. And empower consumers by offering repair information and DIY options.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The lifetime of our electronic appliances is <\/span><a href=\"https:\/\/www.eea.europa.eu\/publications\/europe2019s-consumption-in-a-circular\/benefits-of-longer-lasting-electronics\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">generally lower<\/span><\/a><span style=\"font-weight: 400;\"> than what they\u2019re originally designed for. This <\/span><b>disappoints<\/b><span style=\"font-weight: 400;\"> consumers as they have to pay (often a lot) for new products again. But it\u2019s also a bummer for our environment: producing the new replacement products <\/span><b>depletes<\/b><span style=\"font-weight: 400;\"> natural resources and <\/span><b>heavily impacts<\/b><span style=\"font-weight: 400;\"> the environment.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It feels <\/span><b>very unnecessary<\/b><span style=\"font-weight: 400;\"> \u2013 right?\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The problem is: while product repairs would save environmental impacts \u2013 producers generally make more profit from selling <\/span><b>new products<\/b><span style=\"font-weight: 400;\"> instead. This shows in current product design and the (lack and inconvenience of) repair services offered.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">We need regulation to move away from the current make-use-discard, \u201c<\/span><a href=\"https:\/\/ecochain.com\/blog\/circular-economy-guide\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">linear economy<\/span><\/a><span style=\"font-weight: 400;\">\u201d. This is exactly where the Right to Repair comes into play. This article explains:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">What Right to Repair is;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">How Right to Repair might integrate into EU policy;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">How businesses can use Right to Repair to reduce their product\u2019s environmental impact.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">What is the \u201cRight to Repair\u201d?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Right to Repair is a <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Right_to_repair\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">concept<\/span><\/a><span style=\"font-weight: 400;\">. International and European <\/span><a href=\"https:\/\/blog.ipleaders.in\/right-repair-movement-around-world\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">political movements<\/span><\/a><span style=\"font-weight: 400;\"> aim to bring this concept into their countries\u2019 legislation. The <\/span><a href=\"https:\/\/www.youtube.com\/watch?v=LFNxyDjrpNE\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">main aims<\/span><\/a><span style=\"font-weight: 400;\"> include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Better availability and quality of spare parts,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Repair information, and software updates;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Products are designed for future repair and planned disuse is banned.\u00a0<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">Current EU legislation\u2019s \u201cattempt to repair\u201d<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">To a limited extent, the ideas of the \u201cRight to Repair\u201d are already present in current EU law:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consumer rights are protected with the <\/span><b>legal guarantee period<\/b><span style=\"font-weight: 400;\"> (part of the <\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=uriserv:OJ.L_.2019.136.01.0028.01.ENG\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">sale of goods directive<\/span><\/a><span style=\"font-weight: 400;\">). In case a product was <\/span><i><span style=\"font-weight: 400;\">sold<\/span><\/i><span style=\"font-weight: 400;\"> in a faulty state, sellers and producers need to provide a free repair, replacement, or (partial) reimbursement.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Car manufacturers must provide diagnostic equipment, and repair-\/ maintenance- information to official repairers since 2007, according to the <\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/en\/ALL\/?uri=CELEX%3A32007R0715\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">type-approval legislation<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>Ecodesign directive <\/b><span style=\"font-weight: 400;\">(2009\/125\/EC) enforces for some products<\/span><span style=\"font-weight: 400;\">: minimum requirements for spare part availability and delivery, and availability of maintenance information to professional repairers.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Repairability of products is evaluated positively when classifying \u201csustainable investments\u201d under the <\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX:32020R0852\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">EU Taxonomy Regulation<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">However, these regulations don\u2019t do much for the circular economy. They don\u2019t empower consumers to repair a product that breaks down in their possession.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Repairability requirements now only exist for a few products, and planned disuse (planned short product life) isn\u2019t tackled. <\/span><b>Repairs remain costly and inconvenient.\u00a0<\/b><\/p>\n<h2><span style=\"font-weight: 400;\">Summary: Right to Repair in upcoming EU regulation\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">But there is ambition: the European Parliament has been calling for repair policies in several resolutions since 2004.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Accordingly, the EU commission is developing <\/span><b>several laws and policies<\/b><span style=\"font-weight: 400;\"> for the coming years that include Right to Repair measures. And we summarized their official <\/span><a href=\"https:\/\/www.europarl.europa.eu\/RegData\/etudes\/BRIE\/2022\/698869\/EPRS_BRI(2022)698869_EN.pdf\"><span style=\"font-weight: 400;\">communication<\/span><\/a><span style=\"font-weight: 400;\"> for you.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This overview covers general ideas, concrete Right-to-Repair-measures, and the implementation status of each plan. Keep in mind the different <\/span><a href=\"https:\/\/european-union.europa.eu\/institutions-law-budget\/law\/types-legislation_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">types of EU legislation<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">1. Updating the Ecodesign Directive<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The Ecodesign directive is being <\/span><a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/12567-Sustainable-products-initiative_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">amended<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><span style=\"font-weight: 400;\">The general ideas: (1) products should last longer and be easier to repair. (2) Producers should be more responsible for waste prevention, and (3) there should be sustainable public procurement.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The specific measures proposed:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The new directive will cover \u201cthe broadest possible range of products\u201d (p. 3)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It will require manufacturers (Article 21) and importers (Article 23) to make information on repair available (Article 7) to the end user. Potentially using product passports (Article 8).\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Status of measures<\/b><span style=\"font-weight: 400;\">: Proposal for a regulation<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Additionally, legislation for two new product groups will be added to the Ecodesign directive:<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/p>\n<p>a. <a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/12797-Designing-mobile-phones-and-tablets-to-be-sustainable-ecodesign_en\" target=\"_blank\" rel=\"noopener\"><b>Mobile phones and tablets<\/b><\/a><span style=\"font-weight: 400;\"> could require better availability of commonly damaged parts, cost and ease of repair, and longer availability of software.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Specific measures proposed:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Products are designed in a way so that end-users can repair them. This may enter into force 18 months after the regulation is updated (Point 15, page 3.)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The list of spare parts might be revised or extended, allowing used or third-party parts. The time requirement for spare part availability will be updated. (Article 8)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Status of Legislation: <\/b><span style=\"font-weight: 400;\">Draft.<\/span><\/li>\n<\/ul>\n<p>b. <a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/1581-Review-of-ecodesign-requirements-for-computers-and-computer-servers_en\" target=\"_blank\" rel=\"noopener\"><b>Computers<\/b><\/a><b>\u00a0and computer <\/b><span style=\"font-weight: 400;\">servers may require better repairability and longer lifetimes.\u00a0\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Status of Legislation: <\/b><span style=\"font-weight: 400;\">Draft upcoming.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">2. New Batteries regulation<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The new EU <\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A52020PC0798\"><span style=\"font-weight: 400;\">Batteries regulation<\/span><\/a><span style=\"font-weight: 400;\"> (2020) will cover \u2013 additionally to the currently covered End-of-Life-stage \u2013 the sourcing, production, performance, durability, and Greenhouse-gas emissions of batteries.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The specific measures proposed:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Measure 11, battery design requirements: potential policy measures are obligatory battery removability (medium ambition) or replaceability (high ambition).\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">An electronic system that makes life-cycle and repair information available<\/span><span style=\"font-weight: 400;\"> might be developed (Point 93).\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Status of regulation<\/b><span style=\"font-weight: 400;\">: Proposal for a regulation\u00a0<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">3. Amending the Sale of Goods Directive<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The EU\u2019s Sale of Goods Directive may be <\/span><a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/13150-Sustainable-consumption-of-goods-promoting-repair-and-reuse_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">amended<\/span><\/a><span style=\"font-weight: 400;\">. It could make repair easier for consumers, and encourage the production of longer-lasting and repairable products. As a measure, the legal guarantee period could extend for new and second-hand products and established for repaired goods.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Status of the directive<\/b><span style=\"font-weight: 400;\">: Draft upcoming<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">4. Empowering consumers<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Consumer empowerment plays a key role in the Right to Repair. Via <\/span><a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/12467-Consumer-policy-strengthening-the-role-of-consumers-in-the-green-transition_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">amendments<\/span><\/a><span style=\"font-weight: 400;\"> to the Unfair Commercial Practices Directive and\/or the Consumer Rights Directive, or through a new stand-alone consumer protection instrument \u2013 the following requirements can be enforced:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Providing consumers with reliable information on product durability and reparability<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Better Availability of repair services, spare parts, and repair manuals<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Longer availability of software updates and upgrades<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ban on early obsolescence and greenwashing<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Status<\/b><span style=\"font-weight: 400;\">: Draft upcoming\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Furthermore, the EU might allow its member states to adjust their VAT tax to promote repairs. However, there are no concrete plans yet.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">How to apply Right to Repair in your business<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">We find Right-to-Repair a \u201crather vague concept\u201d<\/span><span style=\"font-weight: 400;\">. But generally, we conclude that in the future:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Producers will likely have to make repair information more openly available<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Products designed for repair will likely gain advantages<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The exact rules follow after the proposals and are adopted as policy. For now, the best you can do is follow the <\/span><a href=\"http:\/\/europarl.europa.eu\/infographic\/legislative-procedure\/index_en.html\"><span style=\"font-weight: 400;\">legislative status<\/span><\/a><span style=\"font-weight: 400;\"> of the proposals that apply to your business \u2013 and of course, we keep this article updated!<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Product repairs benefit environmental footprint results<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Even without the legal requirements, your business can already benefit from <\/span><a href=\"https:\/\/ecochain.com\/blog\/guide-to-sustainable-product-design\/\"><span style=\"font-weight: 400;\">design for repairability<\/span><\/a><span style=\"font-weight: 400;\">. Because repairable products are usually \u201cmore sustainable\u201d, as you extend a product\u2019s life and comparatively fewer new products get produced.\u00a0<\/span><\/p>\n<h4><span style=\"font-weight: 400;\">Using Life Cycle Assessments (LCA) in product design<\/span><\/h4>\n<p><span style=\"font-weight: 400;\">To <\/span><b>prove repairs benefit<\/b><span style=\"font-weight: 400;\"> your product\u2019s footprint to your customers \u2013 you can measure your products\u2019 environmental impacts by performing a Life Cycle Assessment (<\/span><a href=\"https:\/\/ecochain.com\/blog\/life-cycle-assessment-lca-guide\/\"><span style=\"font-weight: 400;\">LCA<\/span><\/a><span style=\"font-weight: 400;\">). LCA is th\u00e9 scientific method to measure all potential environmental and human health impacts of a product.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Your LCA results will most likely improve\/look better compared to \u2018standard products\u2019 that haven\u2019t implemented repairs.
