{"id":1671,"date":"2023-03-21T16:18:43","date_gmt":"2023-03-21T15:18:43","guid":{"rendered":"https:\/\/ecochain.com\/blogs\/espr-2023-overview\/"},"modified":"2025-11-10T10:54:49","modified_gmt":"2025-11-10T10:54:49","slug":"espr-2023-overview","status":"publish","type":"post","link":"https:\/\/ecochain.com\/nl\/blog\/espr-2023-overview\/","title":{"rendered":"Ecodesign Directive for Sustainable Products (ESPR): 2023 Overview"},"content":{"rendered":"<h2><span style=\"font-weight: 400;\">What is the Ecodesign Directive?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><b>EU\u2019s Ecodesign Directive (2009) <\/b><span style=\"font-weight: 400;\">prescribes energy-related Ecodesign criteria<\/span> <span style=\"font-weight: 400;\">for certain products and communicates this through energy labels. So far, it saved consumers 120 Billion euros of energy expenditure (!!), and lowered energy consumption of the regulated products by 10% <\/span><a href=\"https:\/\/ec.europa.eu\/info\/energy-climate-change-environment\/standards-tools-and-labels\/products-labelling-rules-and-requirements\/sustainable-products\/ecodesign-sustainable-products_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">in 2021<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Ecodesign Directive is based on the sustainable design approach: <\/span><a href=\"https:\/\/ecochain.com\/blog\/ecodesign\/\" target=\"_blank\" rel=\"noopener\"><b>Ecodesign<\/b><\/a><span style=\"font-weight: 400;\">. Ecodesign minimizes the life-cycle environmental impacts of a product through design solutions driven by environmental data (measured with <\/span><a href=\"https:\/\/ecochain.com\/blog\/life-cycle-assessment-lca-guide\/\"><span style=\"font-weight: 400;\">LCA<\/span><\/a><span style=\"font-weight: 400;\">). Think of using different materials, energy efficiency, durability, repairability, etc.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">What is the Ecodesign for Sustainable Products Regulation (ESPR)?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The proposed<\/span><b> \u201c<\/b><a href=\"https:\/\/environment.ec.europa.eu\/publications\/proposal-ecodesign-sustainable-products-regulation_en\" target=\"_blank\" rel=\"noopener\"><b>Ecodesign for Sustainable Products Regulation<\/b><\/a><b>\u201d (ESPR) <\/b><span style=\"font-weight: 400;\">will <\/span><b>replace<\/b><span style=\"font-weight: 400;\"> the current EU Ecodesign Directive. It will introduce more extensive Ecodesign requirements for many more product groups. Resulting in consequences for a wider range of companies.<\/span><\/p>\n<p><b>In this article you learn:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">How the ESPR relates to the EU Green Deal policy framework (+ a nice infographic)\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The process and outcomes of ESPR implementation so far;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Which confusing concepts have nothing to do with Ecodesign Directive\/ESPRS;<\/span><\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">How companies can prepare for the ESPR.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">How the ESPR relates to the EU Green Deal<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Ecodesign directive and ESPR sit in a jungle of regulations and plans \u2013 all part of the European Green Deal.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s go through all the layers. This first section of terms deals with the outer layers \u2013 covering the green part in Image 1.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">1. EU\u2019s Green Deal \u2013 The big idea<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_22_2013\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">EU Green Deal <\/span><\/a><span style=\"font-weight: 400;\">is a policy package to make the EU carbon neutral by 2050. Immense funds of about <\/span><a href=\"https:\/\/commission.europa.eu\/strategy-and-policy\/priorities-2019-2024\/european-green-deal\/finance-and-green-deal_en#:~:text=Documents-,Investing%20in%20a%20green%20future,investments%20over%20the%20next%20decade.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">1 trillion <\/span><\/a><span style=\"font-weight: 400;\">euros are available for it. Its promises range from decoupling economic growth from resource use, over nature restoration, to improved public health and well-being.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">2. The circular economy \u2013 A plan for action\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">One policy in the EU Green Deal is the <\/span><b>Circular Economy Action plan<\/b><span style=\"font-weight: 400;\">. The circular economy action plan in turn has different policies, e.g. on empowering consumers in sustainable choices, reducing waste, and: the<\/span><b> \u201csustainable products initiative\u201d.\u00a0<\/b><\/p>\n<h3><span style=\"font-weight: 400;\">3. Sustainable Products Initiative \u2013 Getting down to business<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/qanda_22_2014\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Sustainable Products Initiative\u2019s <\/span><\/a><span style=\"font-weight: 400;\">goal is to \u201cmake sustainable products the norm\u201d. The ESPR is the main policy instrument here. The ESPR will be a regulation, thus: <\/span><a href=\"https:\/\/commission.europa.eu\/law\/law-making-process\/types-eu-law_en#:~:text=Regulations%20are%20legal%20acts%20that,entirety%20on%20all%20EU%20countries.\"><span style=\"font-weight: 400;\">binding <\/span><\/a><span style=\"font-weight: 400;\">for EU member states. We\u2019ll get to know it deeply in the next section.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Sustainable Products Initiative is implemented further through the \u201c<\/span><a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/12822-EU-strategy-for-sustainable-textiles_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">EU Strategy for Sustainable and Circular Textiles<\/span><\/a><span style=\"font-weight: 400;\">\u201d and the revision of the <\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=celex:32011R0305\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Construction Products Regulation<\/span><\/a><span style=\"font-weight: 400;\"> (Image 1). The blue parts in Image 1.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">4. ESPR will replace Ecodesign Directive<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">At the current time of writing (12\/2022) the Ecodesign Directive regulates 31 product categories, posing mainly energy-related criteria. However, the new ESPR wants to cover the<\/span><b> \u201cbroadest possible range of products\u201d <\/b><span style=\"font-weight: 400;\">with more diverse Ecodesign criteria. This means the EU still has to draft new regulations and perform many studies before the ESPR enters into force. This is called the <\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A52022XC0504%2801%29&amp;qid=1651649049970\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Ecodesign and Energy Labeling Work Plan<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">5. Implementing acts<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Each regulated product group in the Ecodesign Directive has its own \u201cimplementing act\u201d. This is a piece of law, that makes the Ecodesign criteria mandatory. Currently, the EU is developing the implementation of acts for new product groups and revising old ones. The new acts still enter into force under the current Ecodesign directive. Once the ESPR enters into force, it will take over these acts and replace the current Ecodesign directive.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Next to Ecodesign criteria, the<\/span><b> ESPR will introduce a digital product passport for all regulated products<\/b><span style=\"font-weight: 400;\">. This makes information available to supply chain actors, regulators, and consumers alike. It will likely also monitor- or even <\/span><b>prohibit the destruction of unsold consumer goods. <\/b><span style=\"font-weight: 400;\">Some other ESPRS sub-goals are visible in the blue core in Image 2 below.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">6. Energy Labels<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The Ecodesign Directive and the Energy Labelling Regulation are \u201c<\/span><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/MEMO_19_1596\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">sister directives<\/span><\/a><span style=\"font-weight: 400;\">\u201d. <\/span><b>They are often mentioned and worked on together<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Product groups with energy labeling requirements also have Ecodesign ruling. But not every product group with Ecodesign ruling needs\/ is suitable for energy labeling.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is how the EU <\/span><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/MEMO_19_1596\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">puts it<\/span><\/a><span style=\"font-weight: 400;\">:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u201cThe Ecodesign Directive (2009\/125\/EC) \u2013 the tool for making products more energy efficient.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Energy Labelling Regulation (EU) 2017\/1369) \u2013 the tool through which the consumer can recognize the best-performing products\u201d<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">On March 1, 2022, energy labeling applied to <\/span><a href=\"https:\/\/energy.ec.europa.eu\/ecodesign-and-energy-labelling-working-plan-2022-2024_en\"><span style=\"font-weight: 400;\">15<\/span><\/a><span style=\"font-weight: 400;\"> product groups.<\/span><\/p>\n<figure id=\"attachment_26419\" class=\"wp-caption alignnone\" style=\"width: 780px;\" aria-describedby=\"caption-attachment-26419\"><img decoding=\"async\" class=\" wp-image-26419\" src=\"https:\/\/ecochain.com\/wp-content\/uploads\/2023\/05\/Screenshot-2023-03-17-at-11.48.38-300x222-1.png\" sizes=\"(max-width: 780px) 100vw, 780px\" srcset=\"\" alt=\"The ESPR and its goals in the circular economy package. - Ecochain\" width=\"780\" height=\"577\" \/><figcaption id=\"caption-attachment-26419\" class=\"wp-caption-text\"><i><span style=\"font-weight: 400;\">Image 2: The ESPR and its goals in the circular economy package. These periodically take stock of the progress made and establish priorities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Some of the insights of the current <\/span><a href=\"https:\/\/energy.ec.europa.eu\/ecodesign-and-energy-labelling-working-plan-2022-2024_en\"><span style=\"font-weight: 400;\">working plan 22-24<\/span><\/a><span style=\"font-weight: 400;\"> for the coming years are:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Coming soon: <\/span><b>Implementing acts on <\/b><a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/12797-Designing-mobile-phones-and-tablets-to-be-sustainable-ecodesign_en\" target=\"_blank\" rel=\"noopener\"><b>mobile phones and tablets<\/b><\/a><b>, and <\/b><a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/1581-Review-of-ecodesign-requirements-for-computers-and-computer-servers_en\" target=\"_blank\" rel=\"noopener\"><b>computers and computer servers<\/b><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">31 product categories to be assessed next -first those*<\/span><span style=\"font-weight: 400;\"> with the highest energy or material efficiency potentials. Regulations might arrive by 2030.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">More focus on non-energy related Ecodesign criteria such as <\/span><b>durability, reparability, recyclability, ease of end-of-life disassembly and reuse, recycled content, etc.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Progress made on requirements for Solar PV-related products.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A repair score was developed, and adding this to energy labels of \u201crelevant products\u201d (e.g. consumer electronics) is considered.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Priority: <\/span><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/MEMO_19_1596\" target=\"_blank\" rel=\"noopener\"><b>rescaling Energy Labels<\/b><\/a><span style=\"font-weight: 400;\"> and adding onto them the European Product Registry for Energy Labelling (<\/span><a href=\"https:\/\/ec.europa.eu\/info\/energy-climate-change-environment\/standards-tools-and-labels\/products-labelling-rules-and-requirements\/energy-label-and-ecodesign\/product-database_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">EPREL<\/span><\/a><span style=\"font-weight: 400;\">) as a QR code.<\/span><\/li>\n<\/ul>\n<p><em><span style=\"font-weight: 400;\">*<\/span><span style=\"font-weight: 400;\">Priority products for the next years (working plan section 4.4): low-temperature emitters, professional laundry machines, and dishwashers, universal external power supplies, and electric vehicle chargers.<\/span><\/em><\/p>\n<h2><span style=\"font-weight: 400;\">How to prepare for the ESPR<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The ESPR will pose Ecodesign criteria for as many products as possible. However, in the next few years, it will be implemented for only a limited range of energy-intense products. Our tip: find out if your products are among them!\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Make LCAs of your products<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The environmental impact of the whole life product cycle is a <\/span><a href=\"https:\/\/link.springer.com\/article\/10.1007\/s11367-021-01893-2\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">prominent theme<\/span><\/a><span style=\"font-weight: 400;\"> in the EU\u2019s environmental regulations. The talk is of a <\/span><i><span style=\"font-weight: 400;\">\u201cwhole life cycle approach to product regulation\u201d<\/span><\/i><span style=\"font-weight: 400;\"> in the ESPR proposal. LCA is currently only prescribed in the EU\u2019s Product Environmental Footprint (PEF) method \u2013 which falls outside of the ESPR. The EU is vague about if- and how it wants LCA as a methodology applied in the context of the ESPR. But it\u2019s very likely it will.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As we know, Ecodesign is all about reducing LCA impacts. Therefore, it\u2019s incredibly likely that the environmental data required by the ESPR will be LCA data. Prepare and already take steps towards Ecodesign (rules) with your product.
